Nebraska state penalties for sexual assault charges vary based on several factors, including: whether or not there was penetration, the age of the alleged victim, and if the alleged victim was injured. Penalties are determined by the degree of the offense, as described below:
- Third degree sexual assault is non-consensual sexual contact which carries a term of up to a year in jail and sex offender registration for 15 years.
- Second degree sexual assault results in injury to the alleged victim. This is a felony carrying 1 to 20 years in prison and/or a fine of $25,000. It also requires sex offender registration.
- First degree sexual assault requires proof of sexual penetration and carries a term of 1 to 50 years in prison and potential lifetime sex offender registration.
In sex offense cases involving children, such as child molestation or child sexual assault, penalties increase drastically. For example, first degree sexual assault of a child carries a term of 20 years to life in prison with a 15-year mandatory minimum.
