Heroin, a derivative of morphine, is a highly addictive drug that commonly leads to addiction, overdose, and death. Heroin Defense in Lincoln
The last heroin case Berry Law handled took place in Seward County. The defendant was pulled over on the interstate carrying a large amount of cash, heroin, and other drugs. The district court judge found the search of the driver’s car to be unlawful because it violated the driver’s fourth amendment rights. All evidence including the heroin was suppressed and the case was dismissed.
Heroin is not common in Nebraska, but when it is found, it is often located during interstate stops and searches. If the stop, detention, or search is unlawful, the case may be dismissed.
Heroin Possession and Distribution Penalties
In Nebraska, simple possession of heroin carries a penalty of up to two years in prison and a fine of up to $10,000. More serious state charges such as possession with intent to distribute or trafficking carry a prison sentence of up to 50 years.
Federal crimes involving manufacturing, drug conspiracies, or distribution of large quantities of heroin often carry a term of 10 years to life in prison in federal court.
